REFUND POLICY OF KOINX

1. Customers are solely responsible for the charges already incurred and Services already rendered. All payment obligations are non-cancellable, and all payments made are non-refundable.

2. In case of breach: As Customer’s sole and exclusive remedy and KoinX’s sole liability for breach of the warranty,

a) KoinX shall reasonably correct the non-conforming Service at no additional charge to the Customer, or

b) in the event KoinX is unable to reasonably correct such deficiencies after efforts made in good-faith, KoinX shall refund Customer amounts paid that are attributable to the defective Service from the date KoinX received such notice. To receive warranty remedies, Customer must promptly report deficiencies in writing to KoinX, but no later than thirty (30) days of the first date the deficiency is identified by Customer.

This warranty will not apply if the error or non-conformance was caused by Customer’s breach of this Agreement or Customer’s or its Users’ misuse of the Services or Software.

3. In case of Termination: Upon any termination for cause by the Customer, KoinX shall refund any prepaid fees covering the remainder of the term after the effective date of termination. Upon any termination for cause by KoinX, the Customer shall pay any unpaid fees covering the remainder of the Term after the effective date of termination. In no event shall any termination relieve Customer of the obligation to pay any fees payable to KoinX for the period prior to the effective date of termination.

4. In case of Force Majeure Event: If the event that a Force Majeure Event continues for a period of thirty (30) consecutive days, the other party may terminate this Agreement with a written notice to the other party. If KoinX is the party experiencing the Force Majeure Event and as a result thereof is unable to provide the Services for the period noted herein, and Customer terminates this Agreement, then KoinX will provide Customer a refund of fees paid by Customer pro-rated as of the date the Force Majeure Event commenced.

5. Exception to our Refund Policy: Please note that we will not entertain a request for refund when we have suspended or terminated your access to the agreed Services due to a violation of our Terms of Service Agreement.
